Spousal Open Work Permit
A Spousal Open Work Permit (SOWP) in immigration refers to a type of work permit
that allows the spouse or common-law partner of certain individuals, such as foreign
students or skilled workers, to work in the country. The purpose of the SOWP is to enable
families to stay together and allow spouses to work during their partner's stay.
Key Features of the SOWP:
1. Eligibility:
Spouse of a temporary foreign worker: If the foreign worker is employed in a skilled
position (classified as NOC 0, A, or B jobs in Canada), their spouse can apply for an SOWP.
Spouse of an international student: The spouse of a full-time international student enrolled
at a designated learning institution (DLI) can also apply.
Spouse of a permanent resident applicant: In some cases, spouses of applicants awaiting
permanent residency through specific immigration streams, such as the Spousal Sponsorship
Program, may be eligible for an open work permit.
2. Open Work Permit Benefits:
The SOWP is an open work permit, meaning it is not employer-specific, and the spouse can
work for any employer in any location.
There is no need for a job offer or a Labour Market Impact Assessment (LMIA), making it
easier for the spouse to secure employment.
3. Validity:
The validity of the SOWP typically matches the length of the primary applicant’s study
permit or work permit. For example, if the skilled worker’s work permit is valid for two
years, the SOWP will also be valid for two years.
The SOWP can be renewed as long as the primary permit holder’s status is maintained.
4. Application Process:
Applications for the SOWP can be submitted either from within Canada or from outside. It is
usually applied for alongside the principal applicant’s permit application, though it can be
applied for separately.
Required documents include proof of the spousal relationship (e.g., marriage certificate)
and the spouse’s legal status (e.g., study or work permit).
Work Experience for Permanent Residency:
Work experience gained on an SOWP may qualify the spouse for immigration pathways like the
Canadian Experience Class (CEC), which can lead to permanent residency.
Benefits of SOWP:
Financial support: It allows spouses to work and support their families while their partner studies or works.
Flexibility: It provides open work opportunities without the need for a specific job offer.
Pathway to PR: Work experience under the SOWP can help spouses qualify for permanent residency under programs like Express Entry.
